Attorney
Peter T. Mavrick has practiced primarily in the areas of labor and
employment litigation for over eleven years. His employment defense
experience includes the following:
- Defending
against charges of discrimination filed with the United States Equal
Employment Opportunity Commission and with the Florida Commission on
Human Relations.
- Defending
state and federal court claims of discrimination, based on age, race,
ethnicity, gender, religion, disability, marital status, refusal to
take a polygraph test, retaliation, and any other protected category.
- Defending
wage claims, including claims for overtime wages, minimum wages, and
Florida law claims for alleged commissions and other unpaid wages.
- Responding to informal claims against employers, including letter responses to minimize the likelihood of unnecessary lawsuits.

new business against claims from former employers of violations of
non-competition contracts, alleged breach of duty of loyalty, alleged

Some of attorney Peter Mavrick's recent defense cases have included the following:
In
2008, attorney Peter Mavrick successfully defended FLX of Miami, Inc.
in federal court in Miami for alleged overtime wages owed. After
limited discovery, including the plaintiff's deposition, Attorney
Mavrick filed a motion for summary judgment that the court later
granted. The grounds for the motion was that the former employee was
exempt from the federal overtime wage law because of the nature of FLX
of Miami, Inc.'s business as a motor carrier and the former employee's
job duties. Attorney Peter Mavrick argued that even if the former
employee actually worked unpaid overtime for the last two years of his
employment, his client was not legally obligated to pay overtime wages.
The court agreed that the former employee's job as dispatcher for the
company trucks removed him from coverage by the federal overtime wage
law, pursuant to the federal Motor Carrier Act. Attorney Mavrick's
client obtained a judgment for costs against the former employee.
In
2007-2008, attorney Peter Mavrick was the lawyer who successfully
defended a company and its principals that were sued in Florida state
court for alleged violations of duties of loyalty and fiduciary duties.
The claim stemmed from a former employer's allegations that a former
employee unlawfully started the business while still employed and
violated loyalty and fiduciary duties to the former employer in the
formation and operation of the new business. After Attorney Mavrick
succeeded winning several motions to dismiss the various amended
complaints and proceeded with discovery against the plaintiff
corporation, the plaintiff voluntarily dismissed its case against Mr.
Mavrick's clients and they paid nothing to the plaintiff. In the same
case, one of Mr. Mavrick's clients counterclaimed against the
plaintiff, and the plaintiff settled that claim with a payment to Mr.
Mavrick's client.
In
2008, attorney Peter Mavrick defended a former officer and shareholder
of a Florida corporation from allegations that he unlawfully possessed
valuable equipment belonging to the plaintiff. After Mr. Mavrick's
client prevailed at an evidentiary hearing, the plaintiff did not
pursue the case further.
In
2008, attorney Peter Mavrick also defended other companies with
successful settlements for substantially less than the amounts sought
by the plaintiffs.
In
2005, attorney Peter Mavrick successfully defended a Florida
corporation at trial in a workers compensation case, and won a defense
verdict.
